Law Enforcement & Legal Issues

There is information on law enforcement, legal and legislative resources available to returning combat veterans in Minnesota.   The Minnesota Judge Advocate General is available to provide direction with legal issues such as custody, child support, divorce, default judgment, repossessions, debt collections, landlord/tenant issues, foreclosures, and school issues.

Lawsuits

If there was a temporary order, permanent order or default judgment taken against you while you were on deployment you may be able to reopen or vacate the order or judgment.

Family Law Issues

The JAG office can assist you in many types of family law issues.  You should speak with a JAG attorney if you are facing such issues as marital dissolution, custody issues, paternity issues, child support or child protection.  They may be able to assist you in solving the issue, or we can provide referrals to family law attorneys who are familiar with service members' rights and concerns.  Any changes to your custody or child support orders while you were deployed or due to military service need to be evaluated.  You may be entitled to a vacation of the judgment or a modification.

Consumer Issues

Contact the JAG office if you have questions about your consumer bills, mortgage, insurance, third-party collections, interest rates, consumer or business loans or installment contracts.

Military or Civilian Criminal Matters

If you have a military criminal matter you are entitled to JAG representation.  If  you have a civilian criminal matter you should contact a JAG attorney immediately.  JAG can identify issues that may affect your military career and future, and provide referrals if needed.

Taxes

Information relating to taxes and deployment can be found online at www.irs.gov/individuals/military/index.html (federal) and http://mt.gov/revenue/ (MT state).  The JAG office does not prepare tax returns.  However, attorneys are available to assist you with specific questions.

Power of Attorney (POA)

You should destroy or revoke your POA.  If you have specific concerns regarding the use of the document while you were gone, contact the JAG.

Claims

You may be reimbursed for personal property lost or damaged during deployment, or while stored by the government during deployment.  Claims are processed through Personal Claims, Fort Leavenworth, 913-684-3564, DSN 552-5371.
